1. DESCRIPTION OF TERMS
FurPlanet Productions provides FurPlanet.com to you, subject to the following Terms Of Service ("TOS"), which may be updated by us from time to time without notice to you; provided that, we will not alter Section 4 ("Privacy Policy") without prior notice to and acceptance by our Registered Members. You can review the most current version of the TOS at any time by bookmarking this page's URL and revisiting. Please note that other FurPlanet Productions Services, outside of the FurPlanet.com System, may be governed by a different TOS.

2. DESCRIPTION OF SERVICES
The FurPlanet System and associated Services are free to the general public to read and view. Some of the more advanced interactive Services may only be available after registering a member profile. FurPlanet provides online and realtime access to products and services for sale through the Internet.  All products and services unless otherwise noted are packaged and shipped by FurPlanet Productions, which may own the copyright to products and services or has obtained a license to retail such products and services.

3. ACCESS TO FURPLANET
In order to use the Services, you must obtain access to the World Wide Web, either directly or through devices that access web-based content, and pay any fees associated with such access. In addition, you must provide all equipment necessary to make such connection to the World Wide Web, including a computer and modem or other access device.

4. PRIVACY POLICY
Pursuant to FurPlanet Productions's privacy policy, we WILL NOT disclose to third parties any aggregate information that we collect through registration or system logging, except as specifically authorized by you unless we believe in good faith that such action is reasonably necessary to comply with the law, legal process, to enforce the TOS, or under any of the other circumstances set forth in our privacy policy, as may be amended from time to time.

5. INDEMNITY
You agree to indemnify and hold FurPlanet Productions, and its subsidiaries, affiliates, officers, agents, co-branders or other partners, and employees, harmless from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of your purchaes through FurPlanet, your use of the purchaes, your connection to the Services, your violation of the TOS, content which you find objectionable, or your violation of any rights of another.

6. MODIFICATIONS TO SERVICES
FurPlanet Productions reserves the right at any time and from time to time to modify or discontinue, temporarily or permanently, the Products or Services (or any part thereof) with or without notice. You agree that FurPlanet Productions shall not be liable to you or to any third party for any modification, suspension or discontinuance of the Services.

7. LINKS TO OUR SERVICES
We reserve the right to refuse linking or displaying website addresses of any Services hosted by FurPlanet Productions by any service or site inside our outside of the FurPlanet Productions system. This includes links and addresses to main entry pages, Services, or Registered Member areas. By linking or advertising our Services or Registered Member areas you agree to remove such information immediately upon notification at our discretion.

8. NOTICES
Notices to you may be made via either email or regular mail. The Services may also provide notices of changes to the TOS or other matters by displaying notices or links to notices to you generally on the Services.

9. COPYRIGHTS
FurPlanet Productions respects the intellectual property rights of others and we ask our users to do the same.  FurPlanet Productions, reserves the copyright to all code, layout, images, and other design elements of the FurPlanet System.  Original artwork and stories purchased through FurPlanet may be copyrighted by third parties who have licensed FurPlanet Productions to retail their products.  Purchasing any product or service through FurPlanet does not imply any copyright transfer under law to the buyer.

10. SHIPPING
FurPlanet uses standard shipping companies for its product deliveries.  These shipping companies may have their own TOS which governs any product during the transport process.  Timely delivery of goods is subject to outside forces not under control of FurPlanet Productions.  Any product lost in transit will be replaced by FurPlanet at no charge to the customer after a reasonable period of time has been allowed for shipping.

11. INFORMATION RETENTION
FurPlanet will retain all information submitted by the customer during the signup or checkout process and will retain the information for an indefinate period of time or until no longer necessary to provide customer service.  Customer credit card information used for purchases, minus the last 4 digits of the credit card number, WILL NOT be retained by FurPlanet nor FurPlanet Productions for any period of time except as needed in the automatic or manual processing of customer orders.  During successful checkout the merchant gateway will provide an Approval Code and Transaction ID to us which will be retained with the customer's order for accounting purposes.

12. WARRANTY AND RETURNS
FurPlanet will accept all returns shipped pre-paid by the customer within 14 days of delivery.  We will honor to replace or return funds based on the type of product defect.  All sales are final unless a defect in material or shipping damage has been detected.  We will not replace goods due to unsatisfactory product content.

13. ACCEPTANCE
The TOS constitutes the entire agreement between you and FurPlanet Productions and governs your use of the Services, superceding any prior agreements between you and FurPlanet Productions (including, but not limited to, any prior versions of the TOS). You also may be subject to additional terms and conditions that may apply when you use affiliate or other FurPlanet Productions Services, third-party content or third-party software. The TOS and the relationship between you and FurPlanet Productions shall be governed by the laws of the State of Texas without regard to its conflict of law provisions. You and FurPlanet Productions agree to submit to the personal and exclusive jurisdiction of the courts located within the county of Dallas, Texas. The failure of FurPlanet Productions to exercise or enforce any right or provision of the TOS shall not constitute a waiver of such right or provision. If any provision of the TOS is found by a court of competent jurisdiction to be invalid, the parties nevertheless agree that the court should endeavor to give effect to the parties' intentions as reflected in the provision, and the other provisions of the TOS remain in full force and effect. You agree that regardless of any statute or law to the contrary, any claim or cause of action arising out of or related to use of the Services or the TOS must be filed within one (1) year after such claim or cause of action arose or be forever barred. The section titles in the TOS are for convenience only and have no legal or contractual effect.

14. AGE CONFIRMATION
By purchasing online using the FurPlanet.com website, you are confirming that you are of legal age per the laws of the United States of America  to purchase material clearly labelled as "adult" or "mature" and FurPlanet and FurPlanet Productions has taken all reasonable pre-cautions to prevent the sale of any adult material to any minor.
